Judge decided to not have Milaydes Moreno Mora deported

Recently, the “Landsverordening Administratieve Rechtspraak”or LAR Court handled a case on a foreigner who appealed the Government’s decision to remove him from Aruba.This appeal was based on the fact that he had to await the decision abroad. Wednesday the decision was made to detract this rule, so this equalizes the interest of both parties involved. 

The citizen in question is Milaydes Moreno Mora, who was sent a deportation order on the 12th of September. At the same time, he was prohibited from entering the island for 66 months. He appealed this decision, and this case was handled on the 5th of October. 

The law permits a temporary decision to postpone the deportation if the negative consequences that await the man outway what he is being deported for. The 43-year-old man was born in Venezuela, and entered Aruba on the 19th of November, 2017. Before that, he had already requested a temporary stay to work as a kitchen helper at Los Cafeteros. On the 17th of August, 2018, he signed a cohabitation with a Dutch citizen. On the 17th of May, 2019, he applied for asylum and on the 13th of January, 2022,  he applied for family reunification.

This citizen is a member of the national chess organization and he went to represent Aruba during the last tournament which took place on the 24th of July in India. Upon his arrival on the 11th of August 2022, they denied his reentry to Aruba, and then it was decided to impose a statutory reporting requirement on him.
