Press Judge: Government is entitled to introduce curfew

Aruba had its first curfew set in March, but The Public Prosecution Service (OM) still decided to ask Court for their opinion on the second curfew(August) because they think this one was different than the first one. 

This case was handled on October 15, and they came to a decision this week. The curfew set was legal. The judge, mr. Debby Angela, who is a press judge, spoke to 24ora.com and explained to the people what this sentence means.

The basis is that there are international Agreements, then the Constitution, and finally, the state of calamity law. Law is used to put a curfew in place, and in this case, they used the state of calamity law. It was a decision that was evaluated every 72 hours because limiting freedom from a person is very serious.

Court decided that the Government can use this kind of measure, even if it did not include other measures, like in March. The Government has the authority to come with rules to guarantee public health safety and, in this case, to avoid the spreading of the virus, mr. Angela explained

Until now, there are 60 cases related to curfew. They all received a fine, community service, or a combination of both. The judge showed compassion for them by giving community service because a lot of them lost their jobs.
